2. Agreement to These Terms

By placing an order through our website, you agree to be bound by these Terms & Conditions. If you do not agree, please do not use this site to place an order.

We reserve the right to update these Terms & Conditions at any time. Changes will apply to orders placed after the date of update.

3. Ordering

  • All orders are subject to acceptance and availability.
  • We reserve the right to refuse or cancel any order at our discretion, for example in cases of pricing errors, stock issues, or suspected fraud.
  • An order confirmation email does not necessarily mean your order has been accepted — a contract is only formed once we confirm the item has been dispatched, or the service provided.
  • Guest checkout: no account is required to place an order. Order confirmations and updates will be sent to the email address provided at checkout, so please ensure it’s correct.

4. Pricing & Payment

  • All prices are listed in GBP (£) and include VAT where applicable, unless stated otherwise.
  • We reserve the right to change prices at any time, but changes will not affect orders already confirmed.
  • Payment is taken at the time of order via Stripe. Payments are processed securely and we do not store your card details.

5. Delivery

  • Delivery times and costs are provided at checkout and on our Shipping & Returns page.
  • Delivery timescales are estimates and not guaranteed. We are not liable for delays caused by circumstances outside our reasonable control (e.g. courier delays, weather, customs).
  • Risk in the goods passes to you once they are delivered to the address provided at checkout.

6. Your Right to Cancel (Consumer Contracts Regulations 2013)

If you are a consumer buying goods online in the UK, you have a legal right to cancel your order within 14 days of receiving your goods, without giving a reason (unless the item is exempt — see below).

To cancel, contact us at info@michaelwakephotography.co.uk within 14 days of receipt.

Once you’ve told us you want to cancel, you have a further 14 days to return the goods, at your own cost unless otherwise stated. Refunds will be processed within 14 days of us receiving the returned item(s), or evidence of return postage.

Exemptions (goods that cannot usually be returned unless faulty): personalised or made-to-order items, perishable goods, sealed items that have been unsealed (e.g. for hygiene reasons), digital downloads once accessed.

7. Returns & Refunds

  • Items must be returned unused, in original packaging where possible, within 14 days of delivery.
  • Please see our full Shipping & Returns page for details on how to initiate a return.
  • Faulty or damaged items: contact us at info@michaelwakephotography.co.uk with photos and your order number, and we’ll arrange a replacement, repair, or refund in line with your rights under the Consumer Rights Act 2015.

8. Product Descriptions

We make every effort to ensure product descriptions, images, and pricing are accurate. However:

  • Colours may vary slightly depending on your screen settings.
  • We do not guarantee that all details are error-free, and reserve the right to correct any errors and, where necessary, cancel affected orders (you will be notified and fully refunded if this happens).

All content on this website — including text, images, logos, and design — is owned by or licensed to Michael Wake Photography and may not be copied, reproduced, or used without our permission.

10. Limitation of Liability

  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
  • Subject to the above, we are not liable for any indirect or consequential loss arising from your use of this website or purchase of products.

11. Privacy & Cookies

Use of this website is also governed by our Privacy & Cookies Policy, which explains how we collect and use your personal data.

12. Governing Law

These Terms & Conditions are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
